Pump-and-dump with a face: the legal underside of celebrity calls

the crptch team · analytics desk · 2 reading time

Celebrity shill tokens are not a gray area but a well mapped legal field where high profile cases have already set precedents. Knowing it is useful both for victims and for those who are "just sharing an opinion".

Legal framework

  • Undisclosed advertising: in the US, promoting a security without disclosing payment is a violation. The Kim Kardashian case (a $1.26 million fine for an EMAX post without disclosing the fee) became a warning precedent for the entire influencer market.
  • Pump-and-dump: coordinated hype with a pre-accumulated position is market manipulation. A number of crypto influencers have also faced criminal cases with actual prison sentences.
  • Civil lawsuits: class action suits by buyers against celebrity promoters (from EMAX to FTX ambassadors) are a separate genre - costly for celebrities even when they win.

What this changes in practice

For celebrities, the risk has grown: top names now more often take payment "outside the token" or add disclaimers. For scammers, nothing has changed: renting the face of an average blogger costs pennies, and liability is blurred across jurisdictions. For the buyer, the takeaway is cynical: a celebrity's presence in a promo does not add legitimacy to the token - it adds a charge that will later be used in the case against it. We track on-chain traces of calls (purchases made before the tweet) in the section.
